Photobook Worldwide ("we", "us", "our") operates this store and website, including all related content, features, tools, products and services (the "Services"). Our Services are powered by Shopify, which enables us to provide them to you. This Privacy Policy describes how we collect, use, and disclose your personal information — including the photographs and designs you upload — when you use the Services or communicate with us.

If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

By using the Services, you acknowledge that you have read and understood this Privacy Policy.

Personal information we collect

Depending on how you interact with the Services and where you live, we may collect or process:

  • Contact details — name, billing and delivery address, phone number, email address.
  • Financial information — payment card and payment account details, transaction details and payment confirmations. We do not store full card details.
  • Account information — username, password, preferences and settings.
  • Transaction information — items you view, add to cart or wishlist, and your orders, returns, exchanges and cancellations.
  • Uploaded content — the photographs, images, text and designs you upload or create in our design editor to personalise your products.
  • Communications — the information you include when you contact our support team.
  • Device information — device, browser and network information, IP address and other unique identifiers.

Where we collect it from

  • Directly from you — when you create an account, use the Services, upload content, or communicate with us.

How we use your personal information

  • To provide the Services, perform our contract with you, process payments, and produce, print, fulfil and deliver your personalised orders using the content you upload.

How we disclose personal information

We disclose personal information to third parties for legitimate purposes, including:

  • Shopify, which hosts and powers the Services (see the Relationship with Shopify section below).
  • Service providers who perform services on our behalf, by category: payment processing; our design-editor provider (which stores and processes the photos and designs you create); shipping and fulfilment; customer support; analytics and advertising; and marketing and communications.
  • Business and marketing partners, to provide marketing and advertising. Depending on where you live, you may have the right to opt out of sharing for targeted advertising (see the Your rights and choices section below).
  • Where you direct or consent, such as to ship your products or through social or login integrations.
  • Our affiliates, within our corporate group.
  • In connection with a business transaction (such as a merger), to comply with legal obligations, or to enforce our terms and protect our rights and those of our users.

We do not sell, rent or trade your personal data for third-party commercial use without your consent.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify and third parties that may be located outside the country where you live. Shopify may also use certain enhanced features that incorporate data from your interactions with our store, other merchants, and Shopify. Third-party links

The Services may link to sites operated by third parties. We are not responsible for their content, privacy or security practices. Please review their policies before providing them with your information.

Children

The Services are not directed at children, and we do not knowingly collect personal information from children under 16 without parental consent. If you believe a child has provided us with their personal information, contact us and we will delete it. We do not have actual knowledge that we sell or share the personal information of individuals under 16.

Security and retention

No security measures are perfect, and we cannot guarantee absolute security. Sensitive information is encrypted in transit, and we do not store full card details. Any information you send us may not be secure while in transit, so please do not use unsecure channels for sensitive information.

How long we keep personal information depends on whether we need it to provide the Services, maintain your account, comply with legal obligations, or resolve disputes. Uploaded photos and designs are retained for a minimum of 30 days after order fulfilment, and longer where needed to resolve an order issue, dispute or legal obligation. Please keep your own copies of the files you upload; we are not required to keep an archival copy.

Your rights and choices

Depending on where you live, you may have some or all of these rights. They are not absolute and may apply only in certain circumstances.

  • Access / know — request access to the personal information we hold about you.
  • Delete — request that we delete your personal information.
  • Correct — request that we correct inaccurate information.
  • Portability — receive a copy of your information and, in certain cases, have it transferred to a third party.
  • Opt out of sale / sharing for targeted advertising — where you have this right, you may opt out at our data-sharing opt-out page.   • Manage communications — opt out of marketing emails using the unsubscribe link in any email. We may still send non-promotional messages about your account or orders.

If you live in the UK or European Economic Area, you may also have the right to object to or restrict processing, and to withdraw consent where we rely on it (without affecting processing done before withdrawal).

We will not discriminate against you for exercising these rights. We may need to verify your identity first, and you may use an authorized agent where the law allows. We will respond within the timeframe required by applicable law.

If you have a complaint about how we handle your personal information, contact us using the details below. Depending on where you live, you may also have the right to appeal our decision or to lodge a complaint with your local data-protection authority.

International transfers

We may transfer, store and process your personal information outside the country where you live. Where we transfer personal information out of the European Economic Area or the United Kingdom, we rely on recognised transfer mechanisms such as the European Commission's Standard Contractual Clauses (or the UK equivalent), unless the destination provides an adequate level of protection.
