By accessing or using this website, our online design editor, and our services (together, the "Service"), you agree to these Terms of Service, a legally binding agreement between Photobook Worldwide ("we", "us", "our") and you. If you do not agree with any part of these Terms, please do not use the Service.

You may browse without an account. An account is required to place orders and to take part in our loyalty program. Our products are designed in our browser-based design editor; no software download is required.

1. Eligibility and age

You must be at least 18 years old to place an order or hold an account. If you are under 18, you may use the Service only with the involvement and consent of a parent or guardian, who accepts responsibility for your use. The Service is not directed at children under 16, and we do not knowingly collect their personal data.

2. Intellectual property

All content we provide — including website content, and the design assets, templates, backgrounds, masks and frames available within our design editor — is owned by us or our licensors and is protected by law. You may use these materials only to create products through the Service, without altering them or removing any proprietary notices, and you may not distribute or copy them without our written permission.

3. Your content and acceptable use

You keep ownership of the photos, text and other materials you upload ("Your Content"). We claim no ownership of it.

You grant us a limited licence to use, reproduce, adapt and process Your Content solely to provide the Service, including producing, printing and fulfilling your order. You confirm that you hold all rights needed to Your Content and that it does not:

a) infringe the publicity, privacy or copyright of another person; b) contain unlawful, obscene, defamatory, abusive or threatening material, or material harmful to children; c) contain viruses or other malicious code; d) promote hatred against any group or individual.

We cannot review all submissions and are not responsible for their content. We may refuse to print, remove, or delete any submission we believe breaches (a)–(d) or is otherwise unacceptable. You agree to indemnify us against claims arising from Your Content or your breach of these Terms.

4. Third-party links and services

The Service may link to or rely on third-party sites and services. We do not control them and are not responsible for them. Your use of a third-party service is governed by that party's own terms.

5. Orders

An order confirmation acknowledges receipt of your order but is not our acceptance of it. Your order is accepted when we dispatch it. We may require additional verification, and may decline any order for a lawful reason.

6. Pricing and payment

All prices are shown in the applicable local currency at checkout. Prices, products and services may change from time to time. You agree to pay all fees and applicable charges, including taxes, duties and any customs or foreign-transaction charges that apply.

Payment is processed securely at checkout through Shopify and our payment providers. We do not store your full card details. If a valid payment cannot be processed, we may refuse the order.

7. Store credit

Store credit is a balance held on your account and applied at checkout toward eligible orders. You can apply part of your balance and pay any remaining amount by another method.

Store credit has no cash value and cannot be exchanged, transferred or withdrawn as cash, except where required by law. It may be issued as a remedy under our Return and Refund Policy or through promotions we run from time to time. Store credit may carry an expiry date, which is shown to you when it is issued; where local law does not permit expiry, it will not expire.

8. Gift cards

A gift card holds a balance you can spend across one or more orders. You can apply part of a gift card and keep the remaining value for later, and you can apply more than one gift card to a single order. Any amount above your available gift card balance is paid by another method.

9. Loyalty program

We may offer a loyalty program that lets you earn benefits such as tier status and store credit. Participation is subject to the program rules, which we may change, and we may modify or end the program at any time.

10. Delivery

Products are delivered to the address you provide at checkout. Delivery times are estimates only and are not a condition of this agreement; a delay is not grounds for cancellation or compensation, except where your statutory rights provide otherwise. Shipping scope is set out in the Shipping Policy.

11. Personalised products

Because our products are made by hand and personalised to your order, minor variation from on-screen images, including slight colour shifts, can occur while meeting our quality standards. Where necessary, we may substitute materials of equivalent or better quality.

You are responsible for reviewing and confirming your design before ordering. Once confirmed at checkout, your design is sent to production and cannot be amended, and we are not responsible for customer-generated errors such as spelling, layout, low-resolution images or ordering mistakes. Your remedies for defective products are set out in the Return and Refund Policy.

12. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available", and we disclaim all implied or express warranties, including merchantability, fitness for a particular purpose, non-infringement and title. Nothing in this section or section 13 excludes rights that cannot be excluded under the mandatory consumer law that applies to you.

13. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental or consequential damages, or for loss of profits, data or goodwill, arising from your use of or inability to use the Service. We are not liable for the unlawful or offensive conduct of other parties.

14. Indemnity

You agree to indemnify and hold harmless Photobook Worldwide, its staff and agents from any damages, losses and reasonable legal costs resulting from your breach of these Terms or your wrongful use of the Service.

15. Force majeure

Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including war, strikes, civil unrest, fire, flood, earthquake or natural disaster.

16. Governing law

These Terms are governed by the laws of Malaysia. This does not deprive you of the protection of the mandatory consumer laws, or of your right to bring proceedings before the courts, of the country where you live.

17. Changes

We may update these Terms from time to time. The "Last updated" date reflects the latest version, and continued use of the Service means you accept the changes.

18. Trademarks

The logos and trademarks on the website and products are our property and may not be used without permission. We reserve the right to include our logo on a limited number of products.
